Chapter 13 Bankruptcy

A Chapter 13 Bankruptcy creates a debt repayment plan that protects your assets and allows you to pay only a percentage of your debts from your current income. A Chapter 13 bankruptcy plan lasts either until you pay your debts in full or until the end of a three- to five-year period. You will receive a discharge upon completion of the plan.

To qualify for Chapter 13 bankruptcy you must have a reliable source of income and able to make a plan payment to the Chapter 13 Bankruptcy Trustee. Your Chapter 13 Bankruptcy plan payment is based upon many factors, including your monthly income, your living expenses and what type of debts are included in your case. Each case varies from one person to another.

A Chapter 13 Bankruptcy typically can provide for you to keep your home and your car, even if you are behind in your monthly payments, so long as you have the income to do so. A Chapter 13 Bankruptcy plan can even modify your vehicle loan to a more reasonable interest rate and in some cases only pay the current market value of the vehicle. Chapter 13 Bankruptcy also provides for lien stripping of unsecured second mortgages.

A Chapter 13 Bankruptcy plan can provide for the repayment of past due taxes, past due child support and offers protections and features that are not available under Chapter 7 Bankruptcy.
